MRetail giant Walmart has tapped a former Department of Justice official and prosecutor to lead its compliance department. It appointed Matt Miner to the role of global chief ethics and compliance officer. Miner will lead Walmart’s global compliance program and will report to Rachel Brand, the company’s executive vice president of global governance, chief legal officer, and corporate secretary, according to a company statement.

“Matt is a nationally respected talent in the compliance field, and I am delighted that he will be joining our team,” said Brand. “I’m proud of our strong compliance organization, and I believe that Matt’s expertise and experience with enhancing compliance programs make him the right leader to help take our program to the next level.”

Boasting over 20 years of compliance experience, Miner is joining Walmart from the firm of Morgan, Lewis & Bockius, where he served as partner and as a chief of the Washington office’s white collar enforcement team, advising companies on building up their compliance programs and representing clients in government enforcement matters.

“Walmart has long been a leader and innovator in the business community and that same spirit carries over to the company’s dedication to compliance,” said Miner. “I am absolutely thrilled to join the business. I see this as an opportunity unlike any other to tackle complex and diverse issues as part of a truly extraordinary company.”

Prior to his time at Morgan, Lewis & Bockius, Miner has served stints in the criminal division in the U.S. Justice Department and the prosecutors office for the Middle District of Alabama, and he has worked for the staff of the U.S. Senate Judiciary Committee, where his roles included chief counsel for crime, terrorism, and oversight, according to the company statement. 

Walmart settled a long-running Foreign Corrupt Practices Act case with the DoJ and Securities and Exchange Commission in June of 2019, shortly after Miner arrived at the department in April, 2019.

The U.S. Justice Department has appointed David Last as head of the Foreign Corrupt Practices Act unit, a high-profile division that investigates and prosecutes bribery cases. Last had served as acting chief of the FCPA unit since April 2020 and will now hold the position on a permanent basis.

The FCPA unit investigates and prosecutes companies and individuals for paying bribes to foreign public officials, under the Act of the same name passed in 1977.

At a virtual conference in March, Last said he is looking forward to “getting under the hood” of compliance programs across the country and ensuring that programs are “well-designed, adequately resourced, empowered to function effectively, able to sufficiently address risks, and responsive to risks when they arise.”

Violations of the FCPA are usually enforced through settlements with offending companies and individuals, while sometimes enforcement comes in the form of criminal charges against those who pay or receive bribes. While the Securities and Exchange Commission can also enforce the law by bringing civil claims related to the FCPA’s provisions, the DoJ holds the ability to bring criminal charges offenders.

Last has an established career fighting bribery and corruption. Before his appointment to acting head of the unit, Last had served the FPCA unit since April 2016 as a trial attorney, assistant chief, and principal assistant chief. He also worked as an assistant prosecutor in the U.S. Attorney’s office for ten years in the fraud and public corruption section.

The previous FCPA unit chief, Chris Cestaro, left the DoJ to join law firm WilmerHale in April of this year.

Neiman Marcus has appointed Hannah Kim as new chief compliance officer and chief legal officer, effective July 26. Kim will oversee legal and compliance for the chain of luxury department stores and will work to “promote and protect the company’s overall business strategy,” the company said in an announcement.

Kim was most recently chief legal officer at battery manufacturer Energizer Holdings, where she was responsible for legal, compliance, ethics, and regulatory and government affairs. Neiman Marcus noted in a statement that she also brings experience in leading environmental, social, and governance strategy.

Kim’s hiring follows several recent key appointments for the Dallas-based company, including Bob Kupbens as executive vice president and chief product and technology officer, as well as fashion veteran Lisa Aiken as senior vice president and lifestyle director.

“It is an honor to join Neiman Marcus Group at this pivotal time of ongoing growth and transformation,” said Kim. “I’m excited to be a part of how we bring innovative and luxurious experiences to our customers.”

Prior to her three years at Energizer, Kim served in senior roles at Bank of America and Lowe’s. She started her law career at Parker Poe Adams & Bernstein and Alston & Bird, and earned her bachelor’s degree and law degree from the University of Tennessee. She is also a member of the Leadership Council on Legal Diversity.
